Legislation
Alberta Sustainable Resource Development exercises its role as a manager of public natural resources through a variety of legislation, regulations and policies. Sustainable development is best achieved for Alberta when the key players are familiar with the rules and roles for all involved.
Resource managers in both industry and government need clear direction and transparent procedures to achieve a balance between protection of the environment and the needs of the economy. For effective decision-making, the legislation and policy, under which Alberta Sustainable Resource Development operates, must reflect modern approaches. Firm but fair enforcement mechanisms are essential. Legislation and policy must be regularly reviewed and revised to ensure they continue to be effective and efficient, as well as responsive to changing conditions and new information.
The list below summarizes the Acts managed through Alberta Sustainable Resource Development. For the text of the Acts, please check the Legislation section of the Alberta Queen's Printer web site. Responsibilities
THE MINISTER OF SUSTAINABLE RESOURCE DEVELOPMENT IS SOLELY RESPONSIBLE FOR THE FOLLOWING ACTS:

Boundary Surveys Act
This Act states that the government of Alberta shall participate in surveys and demarcation of the boundary lines between Alberta and adjoining provinces or the North West Territory. -
Expropriation Act, Sections 25 to 28 and 72.
These sections govern the Land Compensation Board and authorize the Lieutenant Governor in Council to make regulations prescribing forms for the purposes of the Act. -
Fisheries (Alberta) Act
This Act restricts the marketing of fish and licensing of Albertans to fish. It also states fishery guardians can be appointed to administer this act. -
Forest and Prairie Protection Act
This Act establishes regulations in regard to fire control, prevention and education in the forested and prairie land in Alberta. -
Forest Reserves Act
The Forest Reserves Act provides a process for acquisition of land in order to sustain a forest reserve. -
Forests Act
This Act establishes an annual allowable cut in coniferous and deciduous forests. It prohibits persons from damaging the forest in any way and allows the Minister to construct and maintain forest recreation areas. -
Public Lands Act
This Act deals with the selling and transferring of public land, as well as the management of rangeland and activities permitted on designated land. -
Surface Rights Act
This Act authorizes the establishment of a Surface Rights Board to handle inquiries into disputes over access to land. -
Surveys Act
This Act provides the specific guidelines in order to perform surveys on various types of land. -
Wildlife Act
This Act governs the management of wildlife as a Crown resource and enables the hunting and trapping of wildlife, stating that the remains of dead animals are the property of the Crown unless otherwise specified; also addresses conservation of species at risk (endangered, threatened).
THE MINISTER OF SUSTAINABLE RESOURCE DEVELOPMENT SHARES RESPONSIBILITY FOR ALL OR PARTS OF THE FOLLOWING ACTS:

Environmental Protection and Enhancement Act, Sections 30 to 34, in common with Minister of Environment.
These sections govern the Environmental Protection and Enhancement Fund, the Revolving Fund and the Environmental Protection Security Fund. -
Environmental Protection and Enhancement Act, Sections 37(d) to (j), in common with Minister of Community Development and Minister of Environment.
These sections authorize the Lieutenant Governor in Council to make regulations respecting delegated authorities. (See the Forest Resources Improvement Regulation under the Forests Act and the Wildlife Regulation under the Wildlife Act. -
Government Organization Act, Sections 4(2)(f) and (g) of Schedule 5, in common with the Minister of Environment and Minister of Infrastructure.
These sections authorize the Lieutenant Governor in Council to make regulations authorizing the acquisition of land in a Restricted Development Area (RDA) or to acquire shares in a corporation that holds land in an RDA. This Act gives procedures for the Minister and others below him to follow when performing tasks such as buying land, amending regulations, and appeals of enforcement orders. -
Mines and Minerals Act, Sections 108(g), (h) and (j), in common with the Minister of Energy.
This Act specifies the general powers of the Minister and the process which one must take in order to obtain a mine or minerals. It gives procedures to obtain the rights for minerals and the repercussions of disobeying regulations. -
Natural Resources Conservation Board Act, in common with the Minister of Environment.
This Act provides for an impartial process to review projects that can affect natural resources in Alberta. The Board considers if the projects are in the public's best interest and the effect of the project on the environment. -
Surveys Act, Sections 5(1)(d) and (2)(b), in common with the Minister of Government Services. These sections relate to the development and maintenance of a land-related information systems network for Alberta.
