Disclosure of Contraventions and Unauthorized Use

The Public Lands and Forests Division (PLFD) of Alberta Sustainable Resource Development (ASRD) is responsible for the management of forested public lands in Alberta under the Forests Act (Chapter F-22) and the Public Lands Act (Chapter P-40). The PLFD monitors compliance with these Acts and their associated Regulations through a series of regularly scheduled and random audits as well as 'field checks' and by self-reporting disposition holders. Forest Management Branch of PLFD is responsible for establishing auditing protocols which address monitoring requirements. These activities are fundamental to the proper management of Crown land by all land users.

Contraventions of the legislation may be found during these audits, checks and self-reporting. Disposition holders may not have performed their operations within the boundaries of the Act, Regulation, or the terms of their disposition. Typically, during the course of an audit or through self-reporting by a disposition holder, an investigation into possible contraventions of the legislation may be triggered. If, during this investigation, a contravention is discovered the operator will be given the opportunity to voluntarily rectify the contravention. Appropriate penalties, established under the legislation, may be assessed for these contraventions. Section 57 of the Forests Act and section 50 of the Public Lands Act require the Minister to disclose:

  • the name of the person or company who has contravened the legislation or specific conditions associated with the disposition;
  • the municipality in which the person resides or the company is located;
  • a description of the contravention or unauthorized use; and
  • the amount of the payment or penalty, as the case may be.

In fulfillment of these legislated requirements, the following tables summarize the contraventions assessed since this requirement came in to force on May 24, 1996. In all cases appearing below, the respondents have been notified of the penalty assessments and invoiced accordingly.
